TERMS OF SERVICE

Welcome to The Little Herb Shoppe (“The Little Herb Shoppe,” “we,” “us,” or “our”). We operate this website and online store (the “Services”), which are powered by Shopify. By visiting or using the Services, you agree to these Terms of Service (the “Terms”) and our Privacy Policy (available on our website). If you do not agree, please do not use the Services.

1. Access & Account

You represent that you are at least the age of majority in your state or province of residence and that, if applicable, you consent to minor dependents using the Services on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, shipping). You warrant that all information you provide is accurate and complete and that you have rights to provide it. You’re responsible for safeguarding your account credentials and all activity under your account. Accounts are non-transferable.

2. Our Products

We strive to represent products accurately; however, colors and appearance may vary due to device settings. We do not warrant that product appearance or quality will meet your expectations. Product descriptions may change without notice, and we may discontinue items or limit quantities at our discretion.

3. Orders

Placing an order is an offer to purchase. We may accept or decline any order at our discretion. We must receive and process payment before acceptance. If an order is declined, changed, or canceled, we will attempt to notify you using the contact information provided. Purchases are subject to our Return & Refund Policy. You represent that purchases are for personal/household use and not for resale or export.

4. Prices & Billing

Prices, promotions, and discounts may change without notice. The price charged is the price in effect at the time of order and will appear in your confirmation email. Unless stated otherwise, prices exclude taxes, shipping, handling, and any customs/import charges. In-store and third-party pricing may differ. You agree to provide current and accurate payment details and authorize us to charge for all purchases, including applicable taxes and fees.

5. Shipping & Delivery

Processing and delivery timeframes are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you upon transfer to the carrier. See our Shipping Policy for details.

6. Intellectual Property

All content on the Services (including trademarks, text, images, graphics, audio/video, design, and arrangement) is owned by The Little Herb Shoppe or its licensors and protected by applicable laws. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly provided. Unauthorized use may violate intellectual property laws. Shopify and other third-party names and marks are the property of their respective owners.

7. Optional Tools

We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms.

8. Third-Party Links

The Services may link to third-party sites or include third-party materials. We are not responsible for their content, policies, or practices. Access at your own risk and review their terms and privacy policies.

9. Relationship with Shopify

The Services are hosted by Shopify, which enables us to operate our store. Sales are between you and The Little Herb Shoppe, not Shopify. By using the Services, you acknowledge that Shopify is not responsible for your purchases from The Little Herb Shoppe and you release Shopify from claims arising from those transactions.

10. Privacy

Your use of the Services is subject to The Little Herb Shoppe’s Privacy Policy (see our website). Because our store is hosted by Shopify, certain personal information is also processed under Shopify’s Privacy Policy. Information you submit may be processed in other countries to provide the Services.

11. Feedback

If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display that Feedback for any purpose. You represent you have rights to the Feedback, have disclosed any incentives, and that it complies with these Terms. We may, but are not obligated to, monitor or remove Feedback.

12. Errors & Omissions

We may correct errors, inaccuracies, or omissions (including in descriptions, pricing, promotions, shipping charges, transit times, and availability) and update or cancel orders if information is inaccurate—at any time and without prior notice.

13. Prohibited Uses

You may use the Services only for lawful purposes. You agree not to violate laws, infringe IP rights, harass or harm others, transmit malware, send spam, impersonate others, scrape/crawl, or interfere with security or operation. We may suspend or terminate access for violations.

14. Termination

We may terminate or suspend the Services, or your access, at any time in our discretion. Sections intended to survive termination (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will continue to apply.

15. Disclaimer of Warranties

Except as expressly stated by The Little Herb Shoppe, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. Some jurisdictions do not allow certain disclaimers; in such cases, the above may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, The Little Herb Shoppe and its affiliates, officers, employees, agents, contractors, service providers, and licensors will not be liable for any indirect, incidental, punitive, special, or consequential damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Services or products, even if advised of the possibility.

17. Indemnification

You agree to indemnify and hold harmless The Little Herb Shoppe (and Shopify) and their respective affiliates, officers, employees, agents, contractors, licensors, and service providers from claims and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law or third-party rights, or your use of the Services.

18. Severability

If any provision is determined unenforceable, it will be enforced to the maximum extent permitted, and the remainder will remain in effect.

19. Waiver; Entire Agreement

Our failure to enforce a right is not a waiver. These Terms (plus posted policies, including the Privacy Policy and our Shipping and Return & Refund Policies) constitute the entire agreement between you and us regarding the Services.

20. Assignment

You may not assign these Terms without our prior written consent. We may assign or transfer these Terms without notice.

21. Governing Law

These Terms are governed by the laws of the State of New Hampshire, USA, and you consent to the exclusive jurisdiction and venue of the state and federal courts located in New Hampshire.

22. Headings

Headings are for convenience only and do not limit these Terms.

23. Changes to Terms

We may update these Terms from time to time by posting a new version on the website. Material changes will be communicated as required by law. Your continued use of the Services after changes become effective constitutes acceptance.
